Many buyers and sellers believe there is a mandatory statutory rule on this, but the reality is simpler: the parties are free to agree on which lawyer should draft the sale and purchase agreement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nevertheless, certain customs have developed in practice, under which the buyer chooses the lawyer in the majority of cases.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Why Is a Lawyer Required for a Real Estate Sale and Purchase?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In Hungary, the transfer of ownership of a property requires <a href=\"https:\/\/dobrocsi.com\/hu\/ingatlanjog\/\">countersignature by a lawyer<\/a> or a notarial deed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The lawyer&#8217;s tasks include, among others:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>checking the land registry extract;<\/li>\n\n\n\n<li>examination of the <a href=\"https:\/\/dobrocsi.com\/hu\/mit-ellenoriz-az-ugyved-adasvetel-elott\/\">legal status of the property<\/a>;<\/li>\n\n\n\n<li>drafting the sale and purchase agreement;<\/li>\n\n\n\n<li>identifying the parties;<\/li>\n\n\n\n<li>handling the land registry procedure;<\/li>\n\n\n\n<li>preparing the documents required for the registration of ownership.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The lawyer therefore does not merely &#8220;write a document&#8221;, but serves the legal security of the entire transaction.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Who chooses the lawyer in practice?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The law does not prescribe that only the buyer or only the seller may choose the lawyer.
