Many people then ask: how do probate proceedings work, how long do they take, who takes part in them, and when is the inheritance handed over?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Below we present the most important stages of the probate procedure step by step.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\">\n\n\n\n<h2 class=\"wp-block-heading\">What Are Probate Proceedings?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The purpose of probate proceedings is to establish who is entitled, by right of succession, to the deceased&#8217;s assets, rights and obligations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During the procedure, the following take place, among others:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>establishing who the heirs are;<\/li>\n\n\n\n<li>taking any will into account;<\/li>\n\n\n\n<li>clarifying the composition of the estate;<\/li>\n\n\n\n<li>and transferring the estate.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In Hungary, probate proceedings are conducted by a notary public.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\">\n\n\n\n<h2 class=\"wp-block-heading\">1. Reporting the Death<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The procedure begins after the death occurs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After the death certificate has been issued, the competent local municipality prepares an estate inventory if the statutory conditions are met, and collects the data required for the procedure.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\">\n\n\n\n<h2 class=\"wp-block-heading\">2. Preparing the Estate Inventory<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The estate inventory contains, among other things:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the deceased&#8217;s real properties;<\/li>\n\n\n\n<li>their vehicles;<\/li>\n\n\n\n<li>their bank accounts;<\/li>\n\n\n\n<li>their securities;<\/li>\n\n\n\n<li>their holding in a business association;<\/li>\n\n\n\n<li>as well as the known debts.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">On the basis of the inventory, the case is referred to the notary public.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\">\n\n\n\n<h2 class=\"wp-block-heading\">3. The Case Goes to the Notary Public<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">After receiving the estate inventory, the competent notary public examines:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>who the potential heirs are;<\/li>\n\n\n\n<li>whether a will was made;<\/li>\n\n\n\n<li>whether further data need to be obtained;<\/li>\n\n\n\n<li>whether holding a probate hearing is justified.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If all the data are available, the notary public sets the date of the probate hearing.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\">\n\n\n\n<h2 class=\"wp-block-heading\">4.
