Ilyenkor nem elegend\u0151 megv\u00e1rni, hogy \"majd lesz valami\", \u00e9s az sem felt\u00e9tlen\u00fcl el\u00e9g, ha a c\u00e9g ut\u00f3lag \u00e1ltal\u00e1noss\u00e1gban vitatja a k\u00f6vetel\u00e9st.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A felsz\u00e1mol\u00e1si elj\u00e1r\u00e1s c\u00e9lja a fizet\u00e9sk\u00e9ptelen ad\u00f3s jogut\u00f3d n\u00e9lk\u00fcli megsz\u00fcntet\u00e9se, amelynek sor\u00e1n a hitelez\u0151k a t\u00f6rv\u00e9nyben meghat\u00e1rozott m\u00f3don r\u00e9szes\u00fclhetnek kiel\u00e9g\u00edt\u00e9sben. Ez\u00e9rt kulcsk\u00e9rd\u00e9s, hogy a k\u00f6vetel\u00e9s a felsz\u00e1mol\u00e1si jog szempontj\u00e1b\u00f3l vitatott vagy nem vitatott k\u00f6vetel\u00e9snek min\u0151s\u00fcl-e.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Mikor sz\u00e1m\u00edthat k\u00fcl\u00f6n\u00f6sen vesz\u00e9lyesnek a helyzet?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A helyzet k\u00fcl\u00f6n\u00f6sen kock\u00e1zatos, ha a hitelez\u0151 olyan lej\u00e1rt, szerz\u0151d\u00e9sen alapul\u00f3 k\u00f6vetel\u00e9sre hivatkozik, amelyet az ad\u00f3s kor\u00e1bban nem vitatott, \u00e9s a fizet\u00e9si felsz\u00f3l\u00edt\u00e1sra sem teljes\u00edtett.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A b\u00edr\u00f3s\u00e1gi t\u00e1j\u00e9koztat\u00e1s alapj\u00e1n a felsz\u00e1mol\u00e1si k\u00e9relem akkor terjeszthet\u0151 el\u0151, ha az ad\u00f3s a szerz\u0151d\u00e9sen alapul\u00f3, nem vitatott vagy elismert tartoz\u00e1s\u00e1t a teljes\u00edt\u00e9si id\u0151 lej\u00e1rt\u00e1t k\u00f6vet\u0151 20 napon bel\u00fcl sem egyenl\u00edtette ki vagy nem vitatta, \u00e9s az ezt k\u00f6vet\u0151 \u00edr\u00e1sbeli hitelez\u0151i fizet\u00e9si felsz\u00f3l\u00edt\u00e1sra sem teljes\u00edtett.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ez\u00e9rt nem mindegy, hogy a c\u00e9g mikor \u00e9s milyen tartalommal v\u00e1laszolt a kor\u00e1bbi felsz\u00f3l\u00edt\u00e1sokra. Egy k\u00e9sedelmes, \u00e1ltal\u00e1nos vagy bizonytalan tartalm\u00fa vitat\u00e1s sok esetben m\u00e1r nem ny\u00fajt megfelel\u0151 v\u00e9delmet.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">A k\u00f6vetel\u00e9s vitat\u00e1sa: nem mindegy, mikor \u00e9s hogyan t\u00f6rt\u00e9nt<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Felsz\u00e1mol\u00e1si \u00fcgyekben az egyik legfontosabb k\u00e9rd\u00e9s, hogy az ad\u00f3s a k\u00f6vetel\u00e9st megfelel\u0151 id\u0151ben vitatta-e. Ha a c\u00e9g m\u00e1r csak a felsz\u00e1mol\u00e1si k\u00e9relem k\u00e9zhezv\u00e9tele ut\u00e1n kezdi vitatni a tartoz\u00e1st, az sok esetben k\u00e9s\u0151 lehet.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A K\u00faria gyakorlata szerint a hitelez\u0151i k\u00f6vetel\u00e9s vitat\u00e1sa akkor lehet relev\u00e1ns, ha az \u00edr\u00e1sban, legk\u00e9s\u0151bb a hitelez\u0151 fizet\u00e9si felsz\u00f3l\u00edt\u00e1s\u00e1nak k\u00e9zhezv\u00e9tel\u00e9t megel\u0151z\u0151 napig megt\u00f6rt\u00e9nt. A K\u00faria azt is r\u00f6gz\u00edtette, hogy a k\u00f6vetel\u00e9s esed\u00e9kess\u00e9g\u00e9nek \u00e9rdemi k\u00e9ts\u00e9gbe von\u00e1sa \u00f6nmag\u00e1ban is elegend\u0151 lehet a vitat\u00e1s meg\u00e1llap\u00edt\u00e1s\u00e1hoz, ha az megfelel\u0151 id\u0151ben \u00e9s \u00edr\u00e1sban t\u00f6rt\u00e9nt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ez a gyakorlatban azt jelenti, hogy a c\u00e9geknek nem \u00e9rdemes halogatniuk a vit\u00e1s sz\u00e1ml\u00e1kra vagy felsz\u00f3l\u00edt\u00e1sokra adott v\u00e1laszt. Ha a k\u00f6vetel\u00e9s jogalapj\u00e1t, \u00f6sszeg\u00e9t, esed\u00e9kess\u00e9g\u00e9t vagy teljes\u00edt\u00e9s\u00e9t vitatj\u00e1k, azt id\u0151ben, \u00edr\u00e1sban \u00e9s \u00e9rdemi tartalommal kell jelezni.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Mit tehet a c\u00e9g, ha felsz\u00e1mol\u00e1si k\u00e9relmet kapott?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A lehets\u00e9ges l\u00e9p\u00e9sek mindig az \u00fcgy konkr\u00e9t k\u00f6r\u00fclm\u00e9nyeit\u0151l f\u00fcggenek. Nincs minden helyzetre alkalmazhat\u00f3 \u00e1ltal\u00e1nos minta, mert m\u00e1s strat\u00e9gia sz\u00fcks\u00e9ges akkor, ha a tartoz\u00e1s val\u00f3ban fenn\u00e1ll, \u00e9s m\u00e1s akkor, ha a k\u00f6vetel\u00e9s vitathat\u00f3.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A leggyakoribb lehet\u0151s\u00e9gek:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">1. A k\u00f6vetel\u00e9s \u00e9s az iratok s\u00fcrg\u0151s \u00e1ttekint\u00e9se<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Els\u0151 l\u00e9p\u00e9sk\u00e9nt \u00e1t kell n\u00e9zni a felsz\u00e1mol\u00e1si k\u00e9relmet, a hitelez\u0151 \u00e1ltal csatolt iratokat, a fizet\u00e9si felsz\u00f3l\u00edt\u00e1st, a sz\u00e1ml\u00e1kat, a szerz\u0151d\u00e9st \u00e9s a kor\u00e1bbi levelez\u00e9st.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">K\u00fcl\u00f6n\u00f6sen fontos megvizsg\u00e1lni, hogy:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a hitelez\u0151 pontosan mire alap\u00edtja a k\u00e9relmet;<\/li>\n\n\n\n<li>a k\u00f6vetel\u00e9s \u00f6sszege \u00e9s jogc\u00edme megfelel\u0151en igazolt-e;<\/li>\n\n\n\n<li>t\u00f6rt\u00e9nt-e kor\u00e1bbi vitat\u00e1s;<\/li>\n\n\n\n<li>a fizet\u00e9si felsz\u00f3l\u00edt\u00e1s megfelelt-e a jogszab\u00e1lyi k\u00f6vetelm\u00e9nyeknek;<\/li>\n\n\n\n<li>igazolhat\u00f3-e a felsz\u00f3l\u00edt\u00e1s k\u00e9zbes\u00edt\u00e9se;<\/li>\n\n\n\n<li>fenn\u00e1ll-e besz\u00e1m\u00edt\u00e1si, teljes\u00edt\u00e9si vagy egy\u00e9b v\u00e9dekez\u00e9si lehet\u0151s\u00e9g.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A felsz\u00e1mol\u00e1si k\u00e9relem alapj\u00e1ul szolg\u00e1l\u00f3 fizet\u00e9si felsz\u00f3l\u00edt\u00e1snak formai \u00e9s tartalmi k\u00f6vetelm\u00e9nyei vannak, amelyeket k\u00fcl\u00f6n igazs\u00e1g\u00fcgyi miniszteri rendelet is szab\u00e1lyoz.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2. Nyilatkozat a b\u00edr\u00f3s\u00e1g fel\u00e9<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Ha a c\u00e9g felsz\u00e1mol\u00e1si k\u00e9relmet kap, rendszerint b\u00edr\u00f3s\u00e1gi nyilatkozatt\u00e9telre van sz\u00fcks\u00e9g. Ebben az ad\u00f3snak el\u0151 kell adnia, hogy elismeri-e vagy vitatja a k\u00f6vetel\u00e9st, illetve milyen okb\u00f3l nem \u00e1llnak fenn a fizet\u00e9sk\u00e9ptelens\u00e9g meg\u00e1llap\u00edt\u00e1s\u00e1nak felt\u00e9telei.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A nyilatkozat tartalma kiemelten fontos. Nem szerencs\u00e9s \u00e1ltal\u00e1nos, bizony\u00edt\u00e9kok n\u00e9lk\u00fcli vagy pontatlan nyilatkozatot beny\u00fajtani, mert a felsz\u00e1mol\u00e1si elj\u00e1r\u00e1sban a kor\u00e1bbi iratoknak, hat\u00e1rid\u0151knek \u00e9s nyilatkozatoknak d\u00f6nt\u0151 jelent\u0151s\u00e9g\u00fck lehet.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3. Fizet\u00e9s vagy egyezs\u00e9g lehet\u0151s\u00e9g\u00e9nek vizsg\u00e1lata<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Ha a k\u00f6vetel\u00e9s val\u00f3ban fenn\u00e1ll, akkor c\u00e9lszer\u0171 gyorsan megvizsg\u00e1lni, hogy van-e lehet\u0151s\u00e9g a tartoz\u00e1s rendez\u00e9s\u00e9re, r\u00e9szfizet\u00e9sre, egyezs\u00e9gre vagy a felsz\u00e1mol\u00e1si k\u00e9relem visszavon\u00e1s\u00e1ra.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A Cstv. alapj\u00e1n a b\u00edr\u00f3s\u00e1g az ad\u00f3s k\u00e9relm\u00e9re a tartoz\u00e1s kiegyenl\u00edt\u00e9s\u00e9re legfeljebb 45 napos hat\u00e1rid\u0151t enged\u00e9lyezhet. Ez azonban nem automatikus lehet\u0151s\u00e9g, hanem k\u00e9relmezni kell, \u00e9s az \u00fcgy k\u00f6r\u00fclm\u00e9nyeit\u0151l f\u00fcgg, hogy c\u00e9lszer\u0171-e erre hivatkozni.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Fontos, hogy a fizet\u00e9s vagy egyezs\u00e9g jogi k\u00f6vetkezm\u00e9nyeit is \u00e1t kell gondolni, k\u00fcl\u00f6n\u00f6sen akkor, ha a t\u00e1rsas\u00e1g t\u00f6bb hitelez\u0151vel szemben is tartozik, vagy ha a fizet\u00e9s m\u00e1s hitelez\u0151k \u00e9rdekeit \u00e9rintheti.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">4. Annak vizsg\u00e1lata, hogy van-e reorganiz\u00e1ci\u00f3s lehet\u0151s\u00e9g<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Ha a c\u00e9g fizet\u00e9si neh\u00e9zs\u00e9ge nem v\u00e9gleges, hanem \u00e1tmeneti, \u00e9s van re\u00e1lis es\u00e9ly a m\u0171k\u00f6d\u00e9s rendez\u00e9s\u00e9re, akkor bizonyos esetekben felmer\u00fclhet a <strong><a href=\"\/hu\/csodeljaras-csodvedelem-cegeknek\/\">cs\u0151delj\u00e1r\u00e1s vagy m\u00e1s reorganiz\u00e1ci\u00f3s<\/a><\/strong> l\u00e9p\u00e9s lehet\u0151s\u00e9ge.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><a href=\"\/hu\/csodeljaras-es-csodvedelem\/\">A cs\u0151delj\u00e1r\u00e1s c\u00e9lja elt\u00e9r a felsz\u00e1mol\u00e1st\u00f3l<\/a><\/strong>: cs\u0151delj\u00e1r\u00e1sban az ad\u00f3s fizet\u00e9si halad\u00e9kot kap, \u00e9s cs\u0151degyezs\u00e9g megk\u00f6t\u00e9s\u00e9re tesz k\u00eds\u00e9rletet. Ez azonban csak megfelel\u0151en el\u0151k\u00e9sz\u00edtett helyzetben lehet val\u00f3di megold\u00e1s.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">5. A c\u00e9gvezet\u0151i felel\u0151ss\u00e9g szempontjainak \u00e1ttekint\u00e9se<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Felsz\u00e1mol\u00e1si kock\u00e1zat eset\u00e9n nemcsak a t\u00e1rsas\u00e1g, hanem az \u00fcgyvezet\u00e9s helyzet\u00e9t is \u00e1t kell tekinteni.
